This process is called &#8220;shielding.&#8221; When a case is shielded, it will no longer be displayed in\u00a0<a style=\"color: #000080;\" href=\"http:\/\/casesearch.courts.state.md.us\/casesearch\/\">Case Search<\/a>\u00a0or be available to the public. Law enforcement officers, and certain agencies and individuals may still <\/span><span style=\"color: #000080;\">be able to review this information, though.<\/span><\/p>\n<h3><strong><span style=\"color: #ff0000;\">HOW IS SHIELDING DIFFERENT FROM EXPUNGEMENT?<\/span><\/strong><\/h3>\n<p><span style=\"color: #000080;\"><strong>SHIELDING<\/strong> does not eliminate your criminal record. It removes from public view court and police records of a conviction for certain types of crimes.<\/span><\/p>\n<p><span style=\"color: #000080;\"><strong>EXPUNGEMENT<\/strong> completely removes a criminal record from court files. In general, a case can be expunged if the court granted a favorable disposition. In most instances, expungement is not available if you were convicted.<\/span><\/p>\n<h3><span style=\"color: #000080;\"><strong><span style=\"color: #ff0000;\">WHAT CONVICTIONS ARE ELIGIBLE FOR<\/span> <span style=\"color: #ff0000;\">SHIELDING?<\/span><\/strong><\/span><\/h3>\n<p><span style=\"color: #000080;\">Convictions which are eligible for shielding include:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000080;\">Disorderly Conduct<\/span><\/li>\n<li><span style=\"color: #000080;\">Disturbing the Peace<\/span><\/li>\n<li><span style=\"color: #000080;\">Failure to Obey a Reasonable and Lawful Order<\/span><\/li>\n<li><span style=\"color: #000080;\">Malicious Destruction of Property in the Lesser Degree<\/span><\/li>\n<li><span style=\"color: #000080;\">Trespass on Posted Property<\/span><\/li>\n<li><span style=\"color: #000080;\">Possession or Administering a Controlled Dangerous Substance<\/span><\/li>\n<li><span style=\"color: #000080;\">Possession or Administering a Non-controlled Dangerous Substance<\/span><\/li>\n<li><span style=\"color: #000080;\">Use of or Possession with Intent to Use Drug Paraphernalia<\/span><\/li>\n<li><span style=\"color: #000080;\">Driving without a License<\/span><\/li>\n<li><span style=\"color: #000080;\">Driving While Privilege is Canceled, Suspended, Refused, or Revoked<\/span><\/li>\n<li><span style=\"color: #000080;\">Driving While Uninsured<\/span><\/li>\n<li><span style=\"color: #000080;\">Prostitution<\/span><\/li>\n<\/ul>\n<h3><strong><span style=\"color: #ff0000;\">WHAT ARE THE REQUIREMENTS FOR FILING FOR SHIELDING?<\/span><\/strong><\/h3>\n<p><span style=\"color: #000080;\">Before filing a request for shielding, you must wait three years after completing any sentence, including any parole, probation, or mandatory supervision.<\/span><\/p>\n<p><span style=\"color: #000080;\">Other requirements are:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000080;\"><strong>You may petition only one court<\/strong>\u00a0(you must choose\u00a0<em>either<\/em>\u00a0the circuit court or District Court).<\/span><\/li>\n<li><span style=\"color: #000080;\">You may file in only\u00a0<strong>one county.<\/strong><\/span><\/li>\n<li><span style=\"color: #000080;\">Include all eligible convictions (from one court in one county) on\u00a0<strong>one petition.<\/strong><\/span><\/li>\n<li><span style=\"color: #000080;\">The court will grant you only\u00a0<strong>one shielding petition over your lifetime.<\/strong><\/span><\/li>\n<\/ul>\n<h3><strong><span style=\"color: #ff0000;\">ARE THERE ANY COURT RECORDS THAT ARE INELIGIBLE FOR SHIELDING?<\/span><\/strong><\/h3>\n<p><span style=\"color: #000080;\">The court cannot grant your request for shielding if:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000080;\">The conviction was for a crime that is &#8220;domestically-related.&#8221;<\/span><\/li>\n<li><span style=\"color: #000080;\">You are a defendant in a pending criminal matter.<\/span><\/li>\n<li><span style=\"color: #000080;\">Other convictions in the &#8220;unit&#8221; or group of related charges are not eligible for shielding.<\/span><\/li>\n<li><span style=\"color: #000080;\">You are convicted of a new crime during the three-year waiting period.<\/span><\/li>\n<\/ul>\n<h3><span style=\"color: #ff0000;\"><strong>HOW DO I REQUEST THAT RECORDS BE SHIELDED?<\/strong><\/span><\/h3>\n<p><span style=\"color: #000080;\"><strong>\u00a0<\/strong><em>There are very specific rules to shielding that can be restrictive<\/em>.<\/span><\/p>\n<p><span style=\"color: #000080;\"><strong>\u00a0\u00a0\u00a0\u00a0\u00a0 You may petition only one court<\/strong>\u00a0 &#8211; you must choose\u00a0<em>either<\/em>\u00a0the circuit court or District Court.<\/span><\/p>\n<ol>\n<li><span style=\"color: #000080;\">You may file in only\u00a0<strong>one county.<\/strong><\/span><\/li>\n<li><span style=\"color: #000080;\">You must include all eligible convictions (from <strong>one court<\/strong> in<strong> one county<\/strong>) on <strong>one petition<\/strong><\/span><\/li>\n<li><span style=\"color: #000080;\"><strong>AND<\/strong>, the court will grant you only\u00a0<strong><em>one shielding petition over your lifetime<\/em>.<\/strong><\/span><\/li>\n<\/ol>\n<h3><span style=\"color: #ff0000;\"><strong>DO I HAVE TO PAY A FEE WHEN I FILE MY PETITION FOR SHIELDING?<\/strong><\/span><\/h3>\n<p><span style=\"color: #ff0000;\"><span style=\"color: #000080;\">There is no filing fee for filing a petition to shield records under the Maryland Second Chance Act<\/span>.<\/span><\/p>\n<h3><span style=\"color: #000000;\">\u00a0<\/span><\/h3>\n","protected":false},"excerpt":{"rendered":"<p>WHAT IS SHIELDING OF CRIMINAL RECORDS?
